Terms of Service

These Terms of Service ("Terms") govern your use of Huddle Nearby (the "App"), a mobile application operated by Aurica Rodica Vartolomei, an independent developer established in Barcelona, Spain, in the European Union ("Huddle", "we", "us"). By creating an account or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App. Questions: iwant2025dev@gmail.com.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract. By using the App you confirm that you meet these requirements.

2. Your account

• You sign in with your Apple or Google account. You are responsible for keeping that account secure and for everything that happens under your Huddle account.
• One person, one account. You may not impersonate anyone, misrepresent who you are, or create additional accounts to evade a restriction.
• Your username must not be offensive, misleading or infringe anyone's rights; we may change a username that breaks this rule.
• You can delete your account at any time from the App. Deletion takes effect after a 30-day grace period during which you can cancel it by signing in again.

3. Content you post

You keep ownership of what you post (posts, comments, profile information, photos). By posting you grant Huddle a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example to resize photos or machine-translate text), display and distribute that content so that the App can work. This includes showing your posts to other users, in link previews and on the public web page of a post opened through a share link, and analysing them with automated tools for safety. The licence ends when you delete the content or your account, except for copies kept in backups for the periods described in the Privacy Policy and for content we must keep to comply with the law.

Posts, comments and your profile are public: every user can see them, and posts can be opened by anyone on the web through a share link. You are responsible for what you post. You agree not to post content that:

• Is illegal, defamatory, threatening, harassing, hateful or discriminatory.
• Violates anyone's privacy or intellectual property, or reveals someone else's personal data.
• Promotes violence, terrorism, illegal drugs, sexual exploitation or self-harm, or is sexually explicit.
• Contains spam, scams, malware or unsolicited advertising.
• Misrepresents your identity, your age or a location.

4. Location and places

A post is attached to a public place that you choose (a café, a park, a beach…). The exact coordinates of that place are visible to all users and on the web page of the post. Do not attach a post to a place you want to keep private, such as your home or someone else's address. The App uses your device location only while you use it, to show nearby posts and distances, as described in the Privacy Policy.

5. Notifications

With your permission we send push notifications when someone follows you, comments on your post or replies in a conversation you joined, when a new post appears near you, and as a periodic "nearby" digest. You can turn off follow and comment notifications in the App's settings and all notifications in your device settings.

6. Zero tolerance, reporting and moderation

Huddle has a zero-tolerance policy for objectionable content and abusive users. From inside the App you can report any post, comment or account and block any user so you no longer see their content and they no longer see yours. We review every report and act within 24 hours, removing the offending content and, where warranted, suspending or permanently banning the account. Every post is also screened automatically, by an AI model and a profanity filter, and may be flagged or hidden without notice; decisions to suspend or ban an account are always taken by a person. We contact the authorities when required by law.

If you believe a moderation decision about your content or account was a mistake, you can contest it by writing to iwant2025dev@gmail.com within 30 days. We review every appeal promptly, normally within 14 days, and tell you the outcome.

7. Acceptable use

You agree not to:

• Access the App with automated tools, scrape or bulk-collect content or user data, or create accounts automatically.
• Interfere with the App, its servers or security features, or try to bypass moderation, rate limits or device checks.
• Reverse engineer, copy or resell the App or its data, except where the law expressly allows it.
• Use the App to stalk, track or locate a person, or for any unlawful purpose.

8. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind. We do not guarantee that the App will be uninterrupted or error-free, that places and distances are accurate, or that content posted by other users is accurate, lawful or safe. Meeting people you find through the App is at your own risk; use common sense and meet in public places.

9. Limitation of liability

To the maximum extent permitted by law, Huddle will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of the App or from content posted by other users. Nothing in these Terms limits liability that cannot be limited under applicable law, including consumer rights under EU law.

10. Suspension and termination

We may suspend or terminate your account if you breach these Terms, use the App in a way that may harm other users or the service, or violate any law. Where the law requires it we will tell you the reasons, and you can contest the decision as described in section 6. You may stop using the App at any time by deleting your account.

11. Changes

We may update these Terms from time to time. The "Last updated" date reflects the latest change. Material changes will be announced inside the App before they take effect; if you continue to use the App after that, you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Spain. Any dispute will be resolved by the competent courts of Spain, without prejudice to the consumer rights granted by the law of the country where you live and to mandatory provisions of EU law (including the GDPR and the Digital Services Act). If you are a consumer in the EU you may also use the European Commission's online dispute resolution platform.

13. App stores

The App is distributed through the Apple App Store and Google Play. Apple and Google are not parties to these Terms, have no obligation to provide support or maintenance for the App, and are not responsible for the App or its content. If you downloaded the App from the App Store, Apple's Licensed Application End User License Agreement also applies, and Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
